Despite the proposal conflicting with Development Plan policy, the ‘significant’ weight attached to the benefit gained from care home provision ensured that benefits outweighed harm.

Longstanding HPC client Aspire LPP had sought outline planning permission for the erection of a care home on land west of Borden Lane, Sittingbourne, Kent. Despite Officer recommendation for approval, the application was refused at Committee by Swale Borough Council in July 2025.
The Appeal Hearing took place on 31st March 2026 – the key issue being the location of the site, on the fringe of Borden, within a designated ‘Important Local Countryside Gap’. Whilst the Inspector found that the proposal would have an adverse effect on the ILCG (and conflict with Local Plan policy), the wider Planning Balance was key. The benefit attached to partially offsetting the Borough care home need was afforded significant weight in the overall planning balance, one of several factors which resulted in the appeal being allowed by way of Decision dated 8th July 2026.Highlighting the established Need assessment methodology used within the HPC reports, the Inspector was
